Arbitration Agreement & Class-Action Waiver

PLEASE READ CAREFULLY. THIS AGREEMENT REQUIRES YOU TO RESOLVE DISPUTES THROUGH BINDING, INDIVIDUAL ARBITRATION AND LIMITS THE WAYS YOU CAN SEEK RELIEF. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

1. Agreement to Arbitrate

You and The Maze Game agree that any past, present, or future dispute, claim, or controversy arising out of or relating to the Service, these Terms, marketing communications, or our relationship (a "Dispute") will be resolved by binding individual arbitration, except as provided in Section 6 (Exceptions). This Agreement is governed by the U.S. Federal Arbitration Act (9 U.S.C. §§ 1–16).

2. Informal Resolution

Before initiating arbitration, you agree to send a written Notice of Dispute to legal@themazegame.xyz describing the claim and requested relief. The parties will attempt to resolve the Dispute informally for 60 days.

3. Arbitration Rules

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The seat of arbitration is Wilmington, Delaware, U.S.A. Hearings may be conducted by video or telephone if the amount in controversy is under US$25,000.

4. Class-Action & Jury-Trial Waiver

YOU AND THE MAZE GAME AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims and may award relief only to the individual party. If this waiver is found unenforceable, then the entire Arbitration Agreement is null and void.

5. Fees

We will pay all AAA filing and administrative fees for claims below US$10,000 (unless found frivolous). Otherwise, fees are allocated under AAA rules.

6. Exceptions

Either party may (a) bring claims in small-claims court that qualify, and (b) seek injunctive or equitable relief in court to protect intellectual property rights.

7. 30-Day Opt-Out

You may opt out of this Arbitration Agreement within 30 days of first accepting it by emailing legal@themazegame.xyz with the subject line "Arbitration Opt-Out" and including your account email. Opting out will not affect any other part of the Terms.

8. Survival

This Agreement survives termination of your account.
